Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Fuel Daddy website (fueldaddy.com.au) and the Fuel Daddy mobile app (together, the "Service"), operated by MCD Automotive ("we," "our," or "us").

1. Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it.

2. About the Service

Fuel Daddy is a fuel-price comparison tool covering participating Australian states, plus EV-charger discovery. It lets you compare fuel prices, find nearby stations, track your own fuel use, and (for Premium subscribers) receive price-drop alerts. These Terms apply to both the website and the app; where a clause applies to only one, it says so.

3. Fuel Price Data & Accuracy

Fuel prices, station details, outage information and EV-charger data are sourced from official Government fuel-price schemes and other third-party providers. This information:

• is provided on an "as is" basis and may be delayed, incomplete, or inaccurate;
• can change at any time, including between when it is published and when you arrive at a station;
• is intended as a general guide only, not a guaranteed price or an offer to sell.

Some feeds are updated only once a day or are subject to a reporting delay. You must verify the actual price and fuel availability at the station before purchasing. We do not set fuel prices and are not responsible for the prices, conduct, or stock of any fuel retailer.

4. Licence to Use

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use, subject to these Terms. We may update, suspend, or discontinue any part of the Service at any time.

5. Acceptable Use

You agree not to:

• scrape, harvest, crawl, or bulk-extract data from the Service, or use it to build or train a competing product or dataset;
• copy, resell, sublicense, or commercially exploit any data or content from the Service without our written permission;
• interfere with, overload, or attempt to gain unauthorised access to the Service or its systems;
• use the Service unlawfully, or while driving in a manner that is unsafe or breaches road rules;
• remove or obscure any proprietary notices, or reverse-engineer the app except to the extent permitted by law.

6. Premium Subscriptions (app)

Fuel Daddy offers an optional paid subscription ("Fuel Daddy Premium"):

• subscriptions are sold and processed through Apple's In-App Purchase system, subject to Apple's terms;
• payment is charged to your Apple ID at confirmation of purchase;
• subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period;
• you manage and cancel your subscription in your App Store account settings - not within the app;
• except where required by law, payments are non-refundable; refund requests are handled by Apple.

We may change Premium features or pricing; material changes apply from your next renewal.

7. Your Content & Data

Fuel-tracking entries, favourites, and preferences you create in the app are stored on your device. You are responsible for that data and for keeping your own backups. How we handle information is described in our Privacy Policy.

8. Intellectual Property

The Service, including its design, software, text, graphics, logos, and the "Fuel Daddy" name, is owned by MCD Automotive or its licensors and is protected by intellectual-property laws. Underlying fuel data remains the property of the respective Government schemes and data providers. Nothing in these Terms transfers any of those rights to you.

9. Third-Party Services

The Service relies on third parties including Apple MapKit, Apple In-App Purchases and Push Notifications, state Government fuel-price feeds, and Open Charge Map. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including as to accuracy, reliability, availability, or fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that any price or data is correct or current.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied.

12. Limitation of Liability

To the maximum extent permitted by law, and subject to clause 11, we are not liable for any indirect, incidental, special, or consequential loss, or for any loss arising from your reliance on fuel prices, availability, distances, routes, or other data in the Service - including the price you pay for fuel, wasted travel, or missed savings.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always posted on this page with the "Last updated" date. Significant changes may be announced through the app or website. Your continued use of the Service after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
